Richard McFaul

 

Richard is a commercial litigation solicitor and he joined Birchman & Partners LLP in April 2015.

Practice Areas

Richard undertakes all types of litigation and his practice has a particular focus on construction related disputes and disputes concerning commercial property. He similarly advises on residential property matters concerning boundaries, easements, evictions, rent, and repairs.


In addition, he regularly advises clients on business disputes, partnerships disputes, shareholder disputes and matters involving fraud. He always considers the possibility of early settlement in disputes and has significant experience of Alternative Dispute Resolution (ADR) which has included settling a number of high value claims through mediation.

Previous Legal Experience

At his previous firm Richard acted in wide a range of commercial and media related disputes. He also worked extensively on a £100 million claim in the Commercial Court brought by an East African country against one of its wealthiest citizens.
He completed his legal training with a boutique litigation firm in the City gaining invaluable experience in a wide range of complex fraud and cross border commercial disputes including Yukos Oil related litigations with the Russian Government and Rosneft.


Part of his training also included specialist criminal appeals work where he had some notable successes in the reported cases of: L, HVN, THN &T v R [2013] EWCA Crim 991 in which human trafficking victims had their conviction quashed by the Lord Chief Justice; and in I v R [2012] EWCA Crim 1610 where he successfully appealed his client’s sentence and the Lord Chief Justice provided clarification on the sentencing of youths in the Crown Court.

Background

Prior to joining the legal profession he enjoyed a varied employment history which included working as Director of an Irish charity in Brent, as Director of a project investigating miscarriages of justice, and as an officer investigating hate crimes for a central London borough council.


He is a keen cyclist and cycles to work most days. In his spare time he also enjoys playing both Hurling and Gaelic Football for Brothers Pearse Club in London.
